Terms of Service
These Terms govern Focuddle software, digital character creation and related services provided by , operating as Focuddle (), at .
1. Eligibility and account information
You must be legally capable of entering a contract and provide truthful order information. A parent or legal guardian must authorize use by a minor.
2. License
After valid payment, Focuddle grants you a personal, non-exclusive, non-transferable license to use the delivered desktop software and character package. You may not resell, sublicense, reverse engineer for redistribution, remove rights notices or use the service unlawfully.
3. Uploaded content and likeness rights
You retain rights you already hold in uploaded content. You represent that you own it or possess all permissions required to upload, transform and use it, including consent from depicted people. Do not submit protected characters, third-party artwork, trademarks, confidential material, deceptive celebrity likenesses or unauthorized images of minors.
4. Generated output
Automated output may be inaccurate or similar to other output. We do not guarantee exclusivity, copyright eligibility, trademark availability or non-infringement. You must review output before commercial or public use.
5. Payment and taxes
Checkout may be provided by Paddle as merchant of record. The checkout displays the final price, currency, applicable tax and available payment methods. Your purchase is also subject to the checkout provider's buyer terms.
6. Delivery
Standard software is delivered by download. Custom character work is delivered electronically after payment and receipt of acceptable source material. Estimated delivery displayed at checkout is not guaranteed where additional rights or quality review is required.
7. Acceptable use
Do not use Focuddle for infringement, impersonation, deception, harassment, defamation, unlawful surveillance, sexual exploitation, malware or evasion of platform safeguards.
8. Suspension
We may refuse or suspend an order where content appears unlawful, infringing, deceptive or unsafe. Where appropriate, a refund will be handled under the Refund Policy.
9. Warranty and liability
The service is provided with reasonable care but without guarantees not expressly stated here. Nothing excludes rights or liabilities that applicable law does not permit us to exclude.
